Driving Under the Influence (DUI)

In the State of California, the crime of Driving Under the Influence (DUI), Driving While Intoxicated (DWI), or Drunk Driving actually involves 2 separate charges. Juvenile Law

Three Strikes

In the State of California, any person charged with a felony who has 2 or more PRIOR "strike" convictions can be sentenced to 25 years to Life in State prison. A person charged with a felony who has 1 PRIOR "strike" conviction is ineligible for probation and must serve at least 80% of his/her prison sentence. Prior "strike" convictions are either "serious" felony crimes (Penal Code 1192.7) or "violent" felony crimes (Penal Code 667.5). Being charged with any current felony charge can trigger the Three Strikes law if you have prior "strike" convictions on your record.

The judge has the discretion to dismiss alleged prior "strike" convictions in the interests of justice under People v. Superior Court (Romero). The District Attorney’s office aggressively prosecutes crimes committed by alleged gang members. However, NOT ALL CRIMES COMMITTED BY ALLEGED GANG MEMBERS ARE GANG CRIMES as defined by the Penal Code.
